Guidance on home electrical safety

In England and Wales there is currently no statutory requirement to have annual safety checks on electrical equipment in the home as there is with gas, but it advisable to do so as you can still be liable if things go wrong; there are around 30 deaths and 4,000 accidents annually in the UK involving home electrics.

Electrical safety advice for landlords

If you let property in England and Wales you must ensure that electrical equipment and the electrical system are safe.

So whilst there’s no statutory requirement to have an annual electrical check, the Safety in Rental Property the Landlord's Common Law duty of care, the Landlord & Tenant Act 1985 and several other statutory regulations require that the electrical equipment is safe at the start of every tenancy and maintained in a safe condition throughout the tenancy.

Electrical hazards are also covered by the Housing Health and safety Rating System under the Housing Act 2004.

In the case of commercial property and houses in multiple occupations there is a statutory duty under the Regulatory Reform Fire Safety Order 2005 for the responsible person (the property manager) to carry out annual Fire Safety Risk Assessments, which include electrical safety risks.

If you let property you must also ensure that the electrical system and all appliances supplied are safe to comply with the Electrical Equipment (Safety) Regulations 1994 and the Consumer Protection Act 1987, and not doing so is in opposition to the regulations of the HSE.

These regulations are enforced by the HSE.

Practical safety steps for landlords

You are advised to make visual inspections yourself, recording everything on a safety checklist; make a note of all fuse and breaker ratings on the inventory.

Arrange professional inspections on tenant change-over recording electrical equipment, its condition and fuses fitted. PAT Testing needs to be considered for anything that connects via a 13A plug.

Make sure that tenants know the location of and have access to the main consumer unit, fuses and isolator switch.

We recommend Periodic Inspections of electrical equipment by a qualified electrician to ensure that the electrical system complies with current electrical regulations. These are also known as Fixed Installation Testing and involve the testing of electrical services and systems that conduct electricity around the building. It covers all of the hard wiring in a building and includes items such as the consumer unit, lighting, socket outlets, air conditioning and other fixed plant.

Ask your electrician to ensure an RCD circuit breaker is fitted to power circuits.

Ideally do not supply appliances, but any you do must be complete and maintained in good working order. You must ensure that operating instructions and safety warning notices are supplied with the appliances.

Keep all records of these inspections.
